TERMS AND CONDITIONS

The following terms and conditions apply to all transactions with Icon Tiles Limited. The use of this site indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference. The placement of an order confirms your acceptance of these terms and conditions.


DEFINITIONS

  1. the seller – shall mean Icon Tiles Limited.

  2. the buyer – shall mean any person, company or organisation who agrees to buy goods from the seller.

  3. the goods – shall mean tiles and other products on our website which the buyer agrees to buy from the seller.


DESCRIPTIONS OF GOODS

As all the products that we sell are of a technical nature it is not practical to publish a detailed specification of all the products. All images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. All specifications given to the customer are approximate and intended as a guide only. The company does not accept responsibility for any preparation work based on such specifications.

ACCURACY OF PRODUCT INFORMATION

All product specifications, images and other information published on our website have been made accessible by suppliers, manufacturers, publications or publicists. The intention of Icon Tiles Limited is that all information on the website should be as accurate and up to date as possible. However, due to the manufacturing processes used for our products, Icon Tiles Limited cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.

SAMPLES

Icon Tiles Limited charge £2.50 per sample, including the postage and packaging. The sample is a representation only and will be a cut from a larger tile.

We do not despatch décor or multiples of the same tile.


PAYMENT AND PRICE

The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order. As previously stated, should the price change or be incorrect the contract is void and must be restarted by you the buyer. All prices on our website are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time of placing your order.


TYPOGRAPHICAL ERRORS

In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery prices)


PAYMENT METHODS

We accept all major credit and debit cards including Visa, MasterCard and Switch. On the order you must provide us with your exact billing address and telephone number – the address and phone number your credit card bank has on file for you. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received. If you prefer you can pay by cheque. Please allow an additional 10 days for clearance.


AVAILABILITY OF GOODS

All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.


ORDERS

The buyer shall be responsible for insuring the accuracy of their order. Please check your order carefully and insure all details are correct. Orders accepted by the seller may not be cancelled under any circumstances unless agreed in writing. The buyer shall indemnify the seller in full against all loss incurred by the seller as a result of cancellation. Cancellation of goods ordered to the buyer’s own specification (special orders) will not be accepted.


DELIVERY CHARGES AND DELIVERY TIMES

All prices on our website are exclusive of delivery charges unless otherwise stated. Delivery (stock items) will normally be made within 7 working days from clearance of payment. We will endeavour to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods. The deliveries are made by a single driver and they will only drop at hard roadsides. WE ADVISE ALL CUSTOMERS NOT TO BOOK PLUMBERS, TILERS OR FITTERS BEFORE THEY RECEIVE THE GOODS.


DELIVERY

As soon as we have delivered the goods to your door you will be responsible for them. You (the buyer) will need to make arrangements to take delivery of the goods when they are tendered for delivery. We will only deliver goods to the billing address and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery
. The transport company will contact you direct to arrange a suitable day for delivery. If, for any reason, the buyer fails to take delivery from the transport company a further delivery charge may be made to you.

Each delivery is under a separate contract. If we fail to deliver any part of an order this does not invalidate the contract for the balance.


TIME LIMITATION FOR NOTIFICATION OF CLAIMS

Damage In Transit

If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note and it will be your responsibility to inform us within 48 hours. Any damaged goods should not be accepted on delivery otherwise you the customer must return the product at your own cost, the damaged product should still be noted on the consignment note.

Goods Signed For

Any goods signed for are deemed as being accepted in good condition, we cannot accept any responsibility for damaged goods once the items have been accepted and signed for.

Shortages

It is your responsibility to sign for the correct number of packages as shown on your invoice. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 48 hours from delivery.


REFUND POLICY

Returned Goods

If you are not totally satisfied with your purchase for any reason, you have the right to cancel your order within 7 working days from the date of delivery for full credit or refund, less any applicable delivery charges. It is your responsibility to return any such items in a pristine saleable condition in their original box and packaging. You will be wholly responsible for the return of the goods and any associated costs of return. Goods received back incomplete, damaged or in any condition other than saleable, will be returned to you and the cost of return carriage charged to your account. Prior to returning any products, please contact us within 7 days from the date of delivery. If you do not return goods within 7 days after you have informed us that you wish to cancel your order, your right to cancel will be revoked. The cancellation must be put into writing and received within the 7 day period.



PREVIOUS ORDERS

We cannot guarantee that we will be able to supply the same batch for any subsequent orders of the same tile.


VARIATION CLAIMS

Variation in shade is an inherent characteristic of tiles that may be used to enhance appearance. No guarantees are given that the shade is without variation or may be perfectly matched. All tiles, mosaics and other products are supplied within the producer's tolerance limits of size, texture and colour variation. No claim can be entertained in respect of variations of shading, calibration or otherwise, unless notice in writing is made to the company at its Head Office immediately on receipt of goods. No claim can be entertained after tiles are fixed. No tiles are guaranteed against crazing or chipping.


OTHER

You will own the goods once we have received your payment in full. We do not offer any credit facilities at the moment
. We will issue you with an electronic invoice once we have dispatched the goods to you. Failure by us to enforce any of these terms and conditionswill not affect our right to enforce the rest of these terms and conditions. These terms and conditions are subject to change at any time without prior notice to you.
